Terms and Conditions
1. Scope of Coverage
The following General Terms and Conditions apply to all orders placed through our online shop.
2. Contractual Partner / Conclusion of Contract
When you agree to purchase our products, you enter into a purchase agreement with Good Wood Sports GmbH, Bienenweg 22, 8302 Kloten, Switzerland (hereinafter "Good Wood Hockey" or "Good Wood"), operator of the online shop, www.goodwood.hockey / www.goodwood-hockey.com. Further information about the seller can be found in the imprint. By listing our products in our online shop, we make a legally binding offer to conclude a contract for these items. You can initially add our products to your shopping cart without obligation. Before submitting your binding order, you can correct your information at any time by using the functions provided during the ordering process. The contract is concluded when you accept the items in the shopping cart by clicking the order button. Immediately after submitting your order, you will receive a confirmation by email. If you have chosen PayPal as the payment option, the contract via PayPal is concluded when you confirm your payment method. The language used for the conclusion of the contract is German. We do not store the contract text.
3. Prices and Payment Terms
The prices to be paid by the customer are stated in the specified currency and apply at the time of acceptance of the order by Good Wood Hockey. The prices listed in the online shop include value-added tax but exclude shipping costs (Good Wood Hockey generally does not offer free shipping and clearly indicates this in the respective fields of the online shop) or (if applicable) import duties.
4. Payment
Good Wood Hockey accepts payment for ordered products by credit card or debit card. Good Wood Hockey reserves the right to check credit card or debit card payments before accepting the order. Accepted payment methods can be found on our website.
5. Delivery Conditions
Delivery methods and the estimated delivery time of the order may vary from country to country and are clearly stated on the website. We exclusively ship through shipping service providers. Unfortunately, items cannot be picked up in person. We do not deliver to automated parcel terminals.
6. Retention of Title
The goods remain our property until full payment is made.
7. Right of Withdrawal
The customer has the right to terminate a contract and return any delivered item without giving any reason if the customer has informed Good Wood Hockey in writing within 14 days of delivery. The product must be returned to Good Wood Hockey in its original condition, undamaged, clean, and in the original packaging. The customer bears the cost of returning the goods. Once Good Wood Hockey has been informed of the customer's request to withdraw, the amount charged by Good Wood Hockey will be refunded as soon as possible, but in any case within 30 days of receiving the ordered goods in our warehouse.
8. Transport Damage
If the customer finds that the ordered items were damaged during transport, the delivery person who carried out the delivery should be informed, and Good Wood Hockey's customer service should be contacted by email at hello@goodwood.hockey. Your warranty rights remain unaffected if you do not report the transport damage to the carrier or Good Wood Hockey; however, this makes it easier for Good Wood Hockey to claim against the carrier or transport insurance.
9. Warranty
Defects in items resulting from manufacturing or material defects will be replaced by Good Wood Hockey free of charge. All other warranty rights are expressly excluded. The customer's examination and complaint obligations as well as the warranty period are based on legal provisions. Information about our products (descriptions, videos, images, etc.) does not constitute a guarantee of product properties. The assignment of warranty claims is excluded. To settle a warranty claim, the customer must promptly notify our customer service at hello@goodwood.hockey of the identified defect. Failure to do so will result in the products being deemed approved. The delivery is considered approved if no defect complaint is made to our customer service by email within 8 (eight) days after delivery. All claims made will be reviewed from time to time. The lifespan of Good Wood Hockey products varies depending on the model, the materials used, and the individual use of the product. Excluded from the warranty are claims for defects that are demonstrably due to incorrect fit, normal wear and tear, exceeding the product lifespan, or damage due to improper or negligent use or alteration of the products. Defects in products not obtained through the Good Wood Hockey website are also excluded from the warranty. For our wood-hybrid sticks: Good Wood Hockey offers a one-time repair or replacement ("warranty period") for breaks on a wood-hybrid stick that occur during normal playing conditions within 30 days from the original purchase date, provided the following conditions are met: The product was purchased from an authorized Good Wood Hockey dealer or directly from Good Wood Hockey. The original buyer retains a proof of purchase (receipt) from the original transaction. The warranty claim is made within the applicable warranty period. The product has not been intentionally abused, altered, defaced, or otherwise negligently damaged, including prolonged exposure to adverse weather conditions. The return was made properly and at the customer's expense. Excluded are: Cosmetic issues such as chipping, dents, scratches, or grip wear are not covered by the warranty.
10. Liability
Good Wood Hockey can only be held liable for direct damages and only if the customer proves that these damages are due to gross negligence or unlawful conduct by Good Wood, its employees, or third parties acting on behalf of Good Wood. In any case, the liability of Good Wood is limited to the (purchase) price of the respective order/service. Good Wood Hockey, its employees, or third parties acting on behalf of Good Wood Hockey are excluded from any further liability for other damages. The customer expressly waives any claim for compensation for damages that did not arise from the product itself.
11. Applicable Law and Jurisdiction
Swiss law exclusively applies. This applicable law applies to users only to the extent that the user is not deprived of the protection applicable to him under the mandatory consumer protection laws of his habitual place of residence. The application of the United Nations Convention on Contracts for the International Sale of Goods is excluded. For disputes arising from these General Terms and Conditions, the competent court in Bülach ZH is responsible.
12. Data Protection
Good Wood Hockey adheres to all data protection laws and uses data that can identify the customer only in accordance with the provisions of its privacy policy.
13. Final Provisions
Should individual provisions of these General Terms and Conditions be ineffective, the remaining part of this contract remains unaffected. Instead of the ineffective provision, the relevant legal regulation applies.
The German version of these terms and conditions prevails and is legally binding.
